1. Introduction

These Terms of Service ("Terms") govern your access to and use of the GimartHub website, applications, and services (collectively, the "Platform"). The Platform is operated under the Omnalerge name (referred to here as "GimartHub", "we", "us" or "our"); "Omnalerge" is a trading name and no representation is made as to its incorporation. By creating an account or using the Platform, you agree to these Terms and to the documents incorporated by reference in Section 3.

These Terms are a binding electronic agreement. Under Pakistan's Electronic Transactions Ordinance 2002 (ETO) and equivalent laws elsewhere, electronic acceptance has the same legal effect as a signed paper contract. When you register, you must tick a box that explicitly accepts these Terms and the Privacy Policy; you cannot create an account, and you cannot trade, without doing so. Sellers must additionally accept the Seller Agreement before their account is activated for selling. GimartHub records each acceptance (your account, the policy version, the date/time and IP address) as an electronic record.

If you do not agree, do not use the Platform.

2. What GimartHub is (and is not)

GimartHub is an online marketplace and escrow venue that lets users ("Sellers") list digital gaming assets and services and lets other users ("Buyers") purchase them. Assets and services include game accounts, in-game currency/credits, in-game items and skins, and power-leveling / boosting services ("Listings").

GimartHub is not a party to the contract of sale between a Buyer and a Seller. We are a neutral intermediary and venue that provides listing tools, discovery, order management, an escrow mechanism, a messaging workspace, and a dispute-resolution process. We do not own, pre-screen for accuracy, endorse, or guarantee any Listing. We are not the seller of any asset. The contract for every trade is solely between the Buyer and the Seller, who are each fully responsible for it and for their own conduct, tax, and legal compliance. GimartHub bears no liability for that contract or for either party's acts or omissions, and our own liability to any user is limited as set out in sections 15 and 16. Consistent with DMCA safe-harbour principles (17 U.S.C. § 512) and Pakistan's e-commerce policy framework, GimartHub operates a notice-and-takedown process for third-party rights holders (see the DMCA / Copyright Policy).

GimartHub is an independent marketplace. It is not affiliated with, endorsed by, or sponsored by any game publisher or platform, including (without limitation) Riot Games (Valorant, League of Legends), Valve (Steam and Steam assets), Epic Games (Fortnite), Krafton / PUBG Corporation (PUBG: BATTLEGROUNDS), HoYoverse (Genshin Impact), and Electronic Arts (EA SPORTS FC / FIFA). All game titles, publisher names and trademarks are used for identification and discovery only. See the Disclaimer.

Our overall regulatory posture — Pakistani law (ETO 2002, PECA 2016 as amended in 2025, the e-Commerce Policy framework, SBP payment rules, AML/CFT) and international standards (DMCA safe harbour, GDPR/UK GDPR, CCPA/CPRA) — is summarised in the Regulatory & Compliance Framework.

3. Incorporated documents

4. Eligibility

To use the Platform you must:

  • Be at least 18 years old (or the age of majority where you live, if higher).
  • Have the legal capacity to enter into a binding contract.
  • Not be barred from using the Platform under the laws of your jurisdiction, and not be located in a country subject to a comprehensive trade embargo (for example under United Nations, EU, UK or US sanctions) or be a person on a restricted-parties list.
  • Not have been previously suspended or banned from the Platform.

Accounts are for individuals. Business use requires our prior written consent.

5. Accounts and security

  • You must provide accurate registration information and keep it current. You must be at least 18 years old.
  • One account per person. During the testing period we also allow only one account per network / IP address. Creating multiple or duplicate accounts, or using another person's identity, email, or phone number, is a breach of these Terms.
  • Names. Display names and store names may not impersonate GimartHub, its staff, or any other person or brand, may not imply an official or staff role, and may not be obscene, hateful, or abusive. We may reset a name that breaks this rule.
  • Verification. We require a verified email, and — where enabled — a verified phone number and a photo before an account may sell. Your verified phone number and your payout account must be in your own legal name (see the Seller Agreement).
  • You are responsible for all activity under your account. Keep your credentials secret, enable two-factor authentication, and notify us promptly through the contact page of any unauthorised use.
  • Sign-in protection. After several failed sign-in attempts an account is locked for a short period. You can regain access with the password-reset link sent to your email. We email you when your account is accessed from a new device or location.
  • We may require identity verification ("KYC") for certain activities, especially selling above USD 500 in cumulative payouts, in line with the Anti-Money Laundering Act 2010 (as amended) and the FATF Recommendations. See the Seller Agreement.
  • You may not sell, rent, or transfer your GimartHub account.
  • Closing your account. You may delete your account from Settings, or ask us to. When an account is deleted you are signed out everywhere and can no longer log in; your email address and phone number are retained on a block-list so they cannot be used to open a new account; and transaction, payment, dispute, and audit records are kept for the periods set out in the Privacy Policy. During the testing phase an administrator may waive the email/phone block for a specific test account. EU/UK users' erasure rights are described in the Privacy Policy.
  • Unauthorised access to another person's account or data, electronic fraud, electronic forgery, and identity theft are offences under Pakistan's Prevention of Electronic Crimes Act 2016 (PECA, as amended by the 2025 Amendment Act) and comparable laws elsewhere. We maintain audit logs (see Section 20) and cooperate with law enforcement.

6. Listings and orders

  • Sellers are solely responsible for their Listings being accurate, lawful, non-infringing, and compliant with the Prohibited Items Policy. A Listing is an invitation to treat; a binding sale forms when a Buyer's order is accepted and payment is captured into escrow.
  • Buyers are responsible for reviewing a Listing, the Seller's rating and stats, and any applicable third-party rules before purchasing.
  • Prices are set by the Seller in the Listing currency. Buyers pay the Listing price plus any Buyer service fee and applicable taxes, shown at checkout.
  • We may remove or restrict any Listing that we reasonably believe violates these Terms, the law, or a third party's rights, or that presents a fraud or safety risk.

7. Escrow, fees, and payouts

All payments are processed through third-party payment providers and held via our escrow mechanism. The full rules — escrow states, Buyer service fee (currently 0%), Seller commission (10%), currencies (USD, PKR), holds, reserves, and payouts — are in the Escrow & Payments Terms. Refunds and disputes are governed by the Refund & Dispute Policy.

Key points:

  • Funds are held for the Buyer until delivery is confirmed or auto-confirmed after 72 hours.
  • On completion, the Seller's proceeds (minus commission and fees) become payable, subject to a hold window (up to 14 days) and any reserve.
  • GimartHub is not a bank and the escrow balance is not a deposit, e-money, or stored value; it does not earn interest for you.

8. Dispute resolution between users

If a Buyer and Seller disagree about an order, either may open a dispute on the order. GimartHub will review the evidence and make a binding platform decision to release, refund (in full or part), or split the funds, per the Refund & Dispute Policy. This decision resolves the matter on the Platform; it does not prevent either party from pursuing other legal remedies against each other, but GimartHub's role ends with its decision and payout.

9. Your content and licence to us

"User Content" means anything you submit: Listing text and media (including category attributes and any pre-delivery proof media), messages, reviews and review photos, dispute evidence, support tickets and their attachments, seller store customisation (store name, tagline, banner image, accent colour), and profile information. You retain ownership of your User Content. You grant GimartHub a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for formatting and display), and display User Content for the purpose of operating, promoting, and improving the Platform, and as needed for safety, dispute resolution, and legal compliance.

You represent that you have all rights necessary to submit your User Content and that it does not infringe any third party's rights or violate any law or these Terms.

GimartHub Support may add internal notes to tickets and orders that are visible only to our team. Where a support ticket concerns an order, the other party to that order may be added to the ticket so the issue can be resolved. Pre-delivery proof media submitted by a Seller is used for dispute review and is not shown publicly or to the Buyer unless a dispute makes disclosure necessary.

10. Acceptable use

You agree to follow the Acceptable Use Policy. Among other things, you must not: circumvent escrow or fees by moving transactions off-Platform; misrepresent Listings; engage in fraud, chargeback abuse, or money laundering; scrape or overload the Platform; upload malware; harass other users; or list Prohibited Items.

11. Intellectual property

The Platform, including its software, design, logos, and content we create, is owned by GimartHub and its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Platform for its intended purpose. All game titles, publisher names, and trademarks referenced on the Platform belong to their owners and are used for identification and discovery only.

12. Third-party services

The Platform relies on third parties (payment processors, identity verification, hosting, email, analytics). Your use may be subject to their terms. We are not responsible for third-party services, and their availability may affect the Platform.

13. Suspension and termination

  • By you: you may close your account at any time; some obligations (e.g. open orders, disputes, outstanding fees, record-keeping) survive.
  • By us: we may suspend or terminate your access, remove Listings, freeze an escrow or payout pending review, or ban you — with or without notice — if we reasonably believe you have violated these Terms or the law, pose a risk to users or the Platform, or if required by a payment provider or authority.
  • On termination, sections that by their nature should survive (payment obligations, licences you granted, disclaimers, limitation of liability, indemnity, dispute resolution) continue to apply.

14. Disclaimers

To the maximum extent permitted by law, the Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that Listings are accurate, that Sellers will perform, that assets will remain usable, or that the Platform will be uninterrupted or error-free.

GimartHub does not warrant that any game account, currency, item, or boosting service complies with a publisher's terms of service, or that a purchased asset will not be reclaimed, banned, or devalued by a publisher. Buyers assume the risk inherent in trading digital gaming assets.

15. Limitation of liability

To the maximum extent permitted by law:

  • GimartHub will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, goodwill, data, the cost of substitute goods, account bans or claw-backs by a publisher, or the acts, omissions, or default of any Buyer or Seller.
  • GimartHub's total aggregate liability arising out of or relating to the Platform, these Terms, or any transaction — regardless of the number of claims — will not exceed the lesser of (a) the total service fees GimartHub actually earned from your transactions in the 3 months before the event giving rise to the claim, or (b) USD 20. This is a deliberate allocation of risk and applies even if a remedy fails of its essential purpose.
  • Where applicable law does not allow a full exclusion or this cap, GimartHub's liability is limited to the smallest amount permitted by that law.
  • Nothing in these Terms limits liability that cannot lawfully be limited (e.g. for fraud or wilful misconduct by GimartHub itself).

16. Indemnification

You will defend, indemnify, and hold harmless GimartHub and its owners, officers, employees, contractors, and agents from and against any and all claims, demands, investigations, liabilities, damages, fines, penalties, taxes, settlements, and costs and expenses (including full legal fees and the reasonable cost of staff time) arising out of or related to:

  • your use of the Platform, your Listings, your orders, your deliveries, or your User Content;
  • your breach of these Terms, any incorporated policy, or any law or regulation;
  • any illegal, fraudulent, or unauthorised activity by you, including selling an account you later recover or reclaim, chargeback fraud, money laundering, or sanctions breaches;
  • your infringement or misappropriation of any third party's rights, including a game publisher's intellectual property or terms of service; or
  • any dispute between you and another user, a publisher, a payment provider, or an authority.

If GimartHub is sued, charged, fined, or penalised by any court, regulator, payment provider, or other party because of your conduct or your transaction, you will reimburse GimartHub in full for every resulting cost. GimartHub may take sole control of the defence and settlement of any matter subject to indemnification, at your expense, and you will cooperate. This section survives termination of your account.

17. Changes to the Terms

We may change, add to, or remove parts of these Terms at any time, with or without prior notice. Changes take effect when the updated Terms are posted on the Platform, or on any later effective date we state. We may (but are not required to) highlight significant changes by email or an in-Platform notice. It is your responsibility to review the current Terms before each use. Your continued use of the Platform after changes are posted means you accept them. If you do not agree to a change, you must stop using the Platform and may close your account.

18. Governing law and disputes with GimartHub

These Terms are governed by the laws of Pakistan, without regard to conflict-of-laws rules. Subject to any mandatory consumer-protection rights in your country or province of residence (in Pakistan, the applicable provincial consumer-protection law and the consumer provisions of the e-Commerce Policy framework), you and GimartHub agree to the exclusive jurisdiction of the courts of Pakistan for any dispute between you and GimartHub. Nothing here removes a mandatory statutory right a consumer cannot waive.

19. General

  • Entire agreement: these Terms and the incorporated documents are the entire agreement between you and GimartHub about the Platform.
  • Severability: if a provision is unenforceable, the rest remains in effect.
  • No waiver: our failure to enforce a provision is not a waiver.
  • Assignment: you may not assign these Terms; we may assign them to an affiliate or successor.
  • Notices: we send notices to your account email; you send notices via the contact page.
  • Force majeure: neither party is liable for delays caused by events beyond its reasonable control.

20. Records, audit logs and law-enforcement cooperation

To protect users, prevent fraud, resolve disputes, and meet legal obligations, GimartHub keeps records including: your acceptance of these Terms and other policies (with version, time and IP); account and access logs (IP addresses, device/session metadata, login events); the full order timeline; payment-proof submissions and our verification decisions; delivery records; buyer–seller message logs; KYC data where collected; and an internal audit log of administrative and money-movement actions.

Because Sellers transfer high-value accounts and digital items, these records are important evidence if a Seller later recovers or reclaims an account after selling it, or if any other electronic fraud occurs. GimartHub may preserve and disclose records to the FIA, the National Cyber Crime Investigation Agency (NCCIA), the courts, payment providers, or other authorities in response to valid legal process or where reasonably necessary to investigate a crime, protect users, or enforce these Terms. Retention periods are set out in the Privacy Policy and the Regulatory & Compliance Framework.
