DMCA / Copyright Policy

1. Our position

GimartHub respects intellectual-property rights and expects users to do the same. We respond to clear notices of alleged copyright infringement and, in appropriate circumstances, terminate the accounts of repeat infringers.

GimartHub is a neutral intermediary and hosting venue, not the seller of any listed asset. Consistent with the safe-harbour provisions of the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) — and with equivalent notice-and-takedown expectations under EU, UK and Pakistani law — this page lets copyright owners (including game publishers such as Riot Games, Valve, Epic Games, Krafton, HoYoverse and Electronic Arts) request removal of allegedly infringing user content, rather than holding the platform directly liable.

This policy applies to content hosted by GimartHub: Listing text and media, category attributes and pre-delivery proof media, profile and seller store-page content (tagline, banner, colours), messages, reviews and review photos, and support-ticket attachments. Complaints about the underlying game software or a publisher's rights in a game generally concern the publisher, not user-hosted content — see also the Prohibited & Restricted Items Policy, the Disclaimer and the Regulatory & Compliance Framework.

2. Submitting a notice of infringement (takedown request)

Send a written notice to our designated agent through the contact page with the subject "DMCA Takedown". Include all of the following:

1. Your physical or electronic signature. 2. Identification of the copyrighted work you claim has been infringed (or a representative list). 3. Identification of the material you claim is infringing, with enough detail for us to locate it — ideally the Listing URL(s) or message reference. 4. Your contact information: name, address, telephone number, and email. 5. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law. 6. A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorised to act on the owner's behalf.

Incomplete notices may not be actioned. Submitting a materially false notice may expose you to liability for damages under applicable law (17 U.S.C. § 512(f)).

3. What we do with a valid notice

  • We will remove or disable access to the identified material expeditiously.
  • We will take reasonable steps to notify the affected user and provide them a copy of the notice (with your contact details, unless we are legally required to withhold them).
  • We will record the notice for our repeat-infringer tracking.

4. Counter-notice

If your content was removed and you believe this was a mistake or misidentification, you may send a counter-notice via the contact page with the subject "DMCA Counter-Notice", including:

1. Your physical or electronic signature. 2. Identification of the material that was removed and the location where it appeared before removal. 3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification. 4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts of Pakistan (or, for U.S. users, the federal district court for your address), and that you will accept service of process from the person who filed the original notice or their agent.

5. Restoration

If we receive a valid counter-notice, we may forward it to the original complainant. If they do not notify us within 10–14 business days that they have filed a court action seeking to restrain the user, we may restore the removed material at our discretion.

6. Repeat infringers

We maintain a policy of terminating, in appropriate circumstances, the accounts of users who are the subject of repeated valid infringement notices. We may also act on a single egregious infringement. "Repeat" generally means 3 or more separate valid notices, but we may act sooner.

7. Other IP complaints (trademark, publisher takedowns)

  • Trademark: contact us via the contact page with the mark, registration details (if any), the infringing Listing URL, and an explanation of the likely confusion.
  • Publisher / rights-holder takedown: publishers may use the contact page to request removal of Listings for their titles or categories. We evaluate such requests and may restrict or remove Listings, or gate a title, in line with the Prohibited Items Policy.

8. Abuse of this process

Repeated bad-faith or fraudulent notices or counter-notices may result in us ignoring future submissions from you and/or suspending your account.
